 Dear Sir,

With reference to the above-mentioned subject and further to Engineer Letter Ref. (1), The Contractor hereby submits to the Engineer a written proposal for variation which is in the Contractor’s opinion, if will be adopted, will be the best cost to the Employer for the mentioned work, and will be a benefit to the Contract.

Accordingly, the Contractor has prepared this proposal in accordance with the requirements of Sub-Clause 13 [Variation and Adjustments] of the condition of the Contract.

The supporting particulars (i.e., Reinforced Concrete Class-A 30/20, Quotations, etc) for this proposal are attached herewith in order to enable the Engineer’s Personnel / Employer to issue his instruction at the earliest.

Dear Sir,

We acknowledge with thanks the safe receipt of the above referenced Work Order, which we confirm acceptance subject to our conditions as listed below:

As discussed and agreed the Work Order execution until successful and timely completion shall be the full responsibility of M/s. AL Geemi & Partners Contracting Co. LLC.

M/s. Tiger Gulf shall not be held responsible of any breach of the Work Order caused by M/s. Al Geemi & Partners Contracting Co. L.L.C.

M/s. Tiger GULF shall not be responsible for the supervision of the execution of the Work Order (As detailed below) which will be carried out by M/s. Al Geemi & Partners Contracting Co. L.L.C;

·         Direct supervision of the physical work execution and ensure it meets all applicable requirements to the satisfaction of Hattar Management.

·         Ensure that all QA/QC procedures, along with submission of Material Submittals, Material Samples and application for approvals…etc implemented by M/s. Al Geemi & Partners Contracting Co. L.L.C, are meeting the applicable requirements of ADM specifications and to the satisfaction of Hattar Management.

·         Ensure that all HSE procedures implemented by M/s. Al Geemi & Partners Contracting Co. L.L.C, are meeting the applicable requirements of TMA and Hattar Management.

·         Measurements of final quantities to be surveyed by Hattar Management, and agreed between all parties.

·         Preparation and submission of As Built Documents in the right format and number.

·         M/s. Tiger Gulf shall not be held responsible for any eventual claim whatsoever that might be raised by M/s. Al Geemi & Partners Contracting Co. L.L.C. in connection with the above referenced Work Order.

Particular Conditions:

5. Variations in quantities not to be limited to 20%. Measurement and approval of the final quantities to be made by M/s. Hattar Management P and M/s. Al Geemi. Payment to be based on the final quantities measured and approved by both parties, the payment will be issued directly to M/s. Al Geemi.

6. M/s. Tiger /Al Geemi reserves the right to include the VAT into the invoices in case the works goes beyond 2017.

10. M/s. Al Geemi shall be fully responsible for the preparation and submission of all Material Submittals and Material Samples for Hattar Management approval. Hattar Management to provide the approval to M/s. Al Geemi for the same within 5 days.

14. Liquidated damages not applicable.

15. Defects Liability and Warranty not applicable.

Hattar management is respectfully requested to issue the following letters:

-       A letter confirming ZONESCORP’s acceptance of the above conditions.

-       An official letter nominating M/s. Al Geemi & Partners Contracting Co. L.L.C as the subcontractor for the execution of the above mentioned works.
